1. Acceptance of Terms

By accessing or using Shaun Carl Designs' services, website, or any related platforms, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

Shaun Carl Designs provides web design, development, and related services including but not limited to:

  • Custom website design and development
  • Website hosting and maintenance
  • SEO optimization services
  • Website consulting and strategy

3. Project Process

Our typical project process includes:

  • Consultation: Initial discussion to understand your needs and goals
  • Proposal: Detailed scope, timeline, and pricing
  • Design & Development: Building your website according to specifications
  • Review: Opportunity to review and request reasonable revisions
  • Launch: Final deployment and handover

4. Payment Terms

  • Deposits: A deposit of 50% is required before work begins on any project.
  • Balance: The remaining balance is due upon project completion and before final files or access are provided.
  • Payment Methods: We accept credit cards, bank transfers, and other payment methods as agreed upon.
  • Late Payments: Payments not received within 14 days of the due date may incur a 1.5% monthly interest charge.

5. Revisions & Changes

Each project includes a defined number of revision rounds as specified in your proposal. Additional revisions beyond the agreed scope may be subject to additional charges. We reserve the right to charge for:

  • Major scope changes or feature additions
  • Revisions requested after approval
  • Content provided in incompatible formats
  • Delays caused by client's unresponsiveness

6. Client Responsibilities

You agree to:

  • Provide timely feedback and approvals
  • Supply required materials, content, and access credentials
  • Ensure you have rights to any content or materials provided
  • Maintain accurate contact information

7. Intellectual Property

Upon full payment, you will own the final website design and code created specifically for your project, subject to the following:

  • We retain ownership of pre-built templates, components, and code libraries
  • We may display completed work in our portfolio unless otherwise agreed
  • Third-party elements (fonts, plugins, stock images) remain subject to their respective licenses
  • You are responsible for ensuring you have rights to all content you provide

8. Hosting & Maintenance

If you purchase hosting or maintenance services:

  • Services are billed monthly or annually as agreed
  • Services may be cancelled with 30 days written notice
  • We reserve the right to suspend services for non-payment
  • We are not responsible for data loss beyond our control

9. Warranty & Support

  • Bug Fixes: We fix bugs in delivered work at no charge for 30 days after launch
  • Ongoing Support: Additional support beyond the project scope is available at our current hourly rate
  • No Guarantee: We cannot guarantee specific results (such as search rankings or conversion rates) as these depend on many external factors

10. Limitation of Liability

To the maximum extent permitted by law, Shaun Carl Designs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our services.

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Confidentiality

We treat all client information as confidential and do not share it with third parties except as necessary to provide our services or as required by law. This obligation survives the termination of our agreement.

12. Termination

Either party may terminate an engagement with written notice:

  • By Client: At any time, with payment due for work completed up to the termination date
  • By Us: If client breaches terms, fails to provide materials, or becomes unresponsive for extended periods

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Shaun Carl Designs operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after such changes constitutes acceptance of the modified terms.
